Delhi High Court refuses stay on Doosra film release

A vacation bench led by Justice Dinesh Bhatt declined on Thursday to halt the October 23 theatrical release after Sourav Ganguly sought an injunction.

The Delhi High Court on Thursday refused to stop the release of the film Doosra. Justice Dinesh Bhatt observed that the balance of convenience prima facie does not favour Ganguly and listed the matter for Friday.

Ganguly and Luv Films LLP, which is producing a separate biopic of the former captain, filed the plea. Ganguly's counsel argued that the film violates his personality rights and is being promoted using his life and achievements. The filmmakers' counsel said Doosra is not a biopic, that necessary permissions were obtained and that more than a hundred theatres have already been booked with advance payments made.

The film, directed by Abhinay Deo and starring Plabita Borthakur, Ankur Vikal and Samidha Guru, is described as a sports drama set between 1991 and 2001 that links a middle-class Rajasthani girl's story with India's 2002 NatWest Series victory.

The court's refusal keeps the film on track while leaving room for further legal arguments on personality rights in sports biopics.
